Ruling
Accused pursued and tailgated a
vehicle driven by one of the complainant's at high speed through an
intersection to "teach her a lesson." The accused's vehicle came into
contact with the vehicle, which then collided head-on with the vehicle driven
by the other complainant. Both complainants died instantly. The accused was
convicted of two counts of dangerous driving causing death. The accused was sentenced
to 21 months in jail. Mitigating factors included the accused's lack of a
criminal record, a favourable pre-sentence report, and the fact the accused had
two trials. Aggravating factors included the multiple complainants, the
apparent lack of remorse, and that one of the deceased was pregnant at the
time.
